Domestic transportation business is considered a business that is very important in distributing products from manufacturers to consumers thoroughly. So transportation of goods will have damage caused by various accidents on the road and the carrier and logistics service provider must bear the burden of the cargo owner in the case of goods or cargo damage during transportation. The Carrier’s Liability Insurance is one of the product that can support the burden of the carriers and logistics service providers and be able to run the business smoothly.

There two kinds of cover in the Carrier’s Liability Insurance as Voyage and Time Policy which can cover within Thailand Territory including for all nearby neighbor countries.
There are wide covers in the Carrier’s Liability Insurance. Under insurance terms can cover loss of or damage to goods that the carriers will responsible when damage during transportation during carriage and within the period of insurance from the moment the goods are loaded on the carrying conveyance until the time of delivery and the carriage is performed by the carrying conveyance specified in the insurance policy. The covers can include loss of or damage to goods which occur in the process of loading on the carrying conveyance and unloading from the carrying conveyance performed by the Assured or his agents or employees.
As the insurance covers under this insurance policy is so wide which will cover all legal liability of the carrier or logistics service providers but there are many exclusions to study as follows:
Loss or damage to, or delay in delivery of the goods carried by the carriers and logistics providers caused by 1. Force majeure or inherent nature of the goods or the fault of the shipper or consignee 2. Deficiency or error in documentation or instruction given by the consignor to the Insured concerning the goods. 3. Leakage or normal wear and tear, or natural loss of weight or quantity of the goods. 4. Insufficiency or unsuitability of packing, packaging or shipping container used for carriage whether undertaken by the Assured or his employees or agents or any other person with whom the Assured must be jointly liable. 5. Malicious act of any person who is not the employee of the Assured to cause destruction or damage to the carrying conveyance or goods entrusted to the Assured for carriage. 6. Delivery of goods to any person other than the consignee or person entitled to receive the goods, or delivery of goods to the wrong destination, or in the manner which does not conform to the law or customs of the trade regarding delivery of goods. 7. Carriage by person or conveyance not stated in the Schedule and outside the scope of cover as provided in Chapter 2 Clause2. 8. Carriage by conveyance stated in the Schedule which has been sold by the Assured regardless of whether or not change has been effected in registration, or whether there is written contract evidencing non-possession or disuse by the Assured. 9. Driving or controlling of carrying conveyance by driver or controller who does not possess valid license as required by law. 10. Deterioration or unfitness of carrying conveyance for safe carriage, or overloading or towing that exceeds the capacity of the carrying conveyance for safe carriage, or stowing in the manner that violates the rules for stowage, or towing in the manner that violates the rules for safe carriage, or without materials normally required to prevent damage to the goods under carriage. 11. Driving or controlling of carrying conveyance by driver or controller who is under influence of addictive drugs or has alcohol in the blood over 50 percentage milligrams. 12. Goods carried by the Assured are lost due to unknown cause and without indication of robbery or theft including robbery or theft committed by employee of the Assured. 13. Theft occurring while the carrying conveyance is abandoned without being attended to and when the driver or controller of the said conveyance or the Assured is still capable of caring for it. 14. The carriage of the following property, unless the shipper has notified the Assured in writing before the carriage, or the characteristics of the property have been recorded in the bill of lading or shipping documents of the Assured and the Assured has notified the Company in writing of the same before commencement of the carriage and the Company has agreed in writing to provide additional cover therefor: 15. Silver bars, ornamental silver, gold bars, ornamental gold, precious metal, jewels or other valuable goods. 16. Currencies, bank notes, bills, bonds, stamps, stamp duties, credit cards, top-up cards, stocks certificates, share certificates, debenture certificates or goods warrants. 17. Art objects, each worth more than THB 20,000 or antiques. 18. Illegal goods, such as narcotics. 19. Dangerous property, dangerous goods, explosives, guns and ammunitions including weapons of war. 20. Property of the Assured or of which the Assured is a joint owner.
Loss of or damage or delay caused by: 1. War, whether declared or not, civil war, mutiny, rebellion, revolution, coup d’etat, declaration of martial law and exercise of power by the state under the law granting such power. 2. Seizure, attachment, detention or destruction of property by officials, governmental organizations or agencies. 3. Radiation, contamination by radioactivity from any nuclear fuel or from nuclear wastes caused by combustion of nuclear fuel, fission or explosion of radioactivity or nuclear components or any hazardous property which may explode in the nuclear process. 4. Loss, or damage, or delay in delivery which occurred while the Assured is able to recover or entitled to receive indemnity under a policy or cover of any other insurance. 5. All consequential losses arising from the loss of or damage to the goods carried by the Assured such as loss of market, interruption of business and production line, loss of use, etc. 6. Loss of or damage to the goods while being stored at the place of storage of the Assured before commencement of carriage or at the place used by the Assured to separate or consolidate goods or to keep goods along the transit route whether or not the goods are discharged from the carrying conveyance.
